How awesome is this little cornr of flickr, you ask? Well, I can sum it up by saying that when I'm asked "If you could have dinner with any five people, who would they be?" Gail Orenstein is on my short list. Most people react to this response with a vacuous visage, straining with all their might to not appear so clueless or out of touch with some celebrated figure they don't want to admit they've never heard of. Then they think I'm pulling their leg. But I'm not.

I swear that I come here for the commentary. Okay, I'll concede that it doesn't hurt that there are heaving bosoms and curvy bare hips to inspire my comments, but grant me some credit for understanding that the photography here transcends the abundance of flesh you first see on the surface. Scratch below the veneer and you'll be compelled to agree with me that what goes on here is vitally important stuff.

In fact, if flickr had to erase all its content but one user's this would be the one to save. I couldn't be more serious. It is not just quintessentially flickr. It's quintessentially the converse of flickr. It's mainstream and liberally accessible...and it's underground and radical. This applies to the pictures and commentary alike.

The bottom line for you: Don't be one of the blank-faced zombies. You're right here for Christ's sake. Take a look around and understand! Capice? Mazel tof!"

She has suffered through this arbitrary decision of Flckr (Yahoo). DELCAMBRE, La. (AP) - Sag your britches somewhere else, this Cajun-country town has decided.
Mayor Carol Broussard said he would sign an ordinance the town council approved this week setting penalties of up to six months in jail and a $500 fine for being caught in pants that show undergarments or certain parts of the body.

Broussard said he has nothing against saggy pants but thinks people who wear them should use discretion. "It's gotten way out of hand out here," he said.

Albert Roy, the councilman who introduced the ordinance, said he thought the fine was a little steep and should be more in the $25 range, but he still favored the measure.

"I don't know if it will do any good, but it won't hurt," Roy said. "It's obvious, and anybody with common sense can see your parts when you wear sagging pants."

Broussard's advice for people who like their pants to hang low: "Just wear it properly. Cover your vital parts. I mean, if you expose your private parts, you'll get a fine. If you walk up and your pants drop, you get a fine. They're better off taking the pants off and just wearing a dress."

Although I do hate this saggy pants thing-it is just another part of youth cuklture-

I had a student here in Turkey who adopts this style, unfortunately he took the bagginess a little too far. Exiting an elevator one morning they sagged all the way to his ankles. Naturally we were all very professional and hardly laughed at all.......

When I as living in Arizona I did a brief documentary on the conditions of the women's jail. Women slept and lived outside in 120 degree heart, lived off balony sandwiches and were denied medical care. One woman had been badly beaten by the male guards because she refused to give up her wedding ring. She needed back surgery after the attack. Pregnant women lost their babies. The LA jails are not as bad but still not a place I would want to spend a day -- and I'm not even an arrogant debutante!

Jail isn't supposed to be a pleasant experience...that's why it's jail. I don't think the inmates should be treated inhumanely, but I have a hard time sympathizing with people who thumb their nose at the law...especially Paris.

I actually know someone who works at Lynwood and has access to Paris. And from what I understand, the heiress has it the "best" out of all the inmates there.

Being brought up as a girl of privilege she has had not an opportunity to live in a jail must less even seeing one. Being a former police officer i can tell you that just visiting a jail if revolting enough for the average person. Frankly I can identify with the girl who's worst experience in life was a bad makeup day or a day with nothing to do when her parents grounded her.

A judge has ordered Paris Hilton returned to jail to serve out her 45-day sentence for a probation violation. She was taken from court screaming "It's not right!" When I as living in Arizona I did a brief documentary on the conditions of the women's jail. Women slept and lived outside in 120 degree heart, lived off balony sandwiches and were denied medical care. One woman had been badly beaten by the male guards because she refused to give up her wedding ring. She needed back surgery after the attack. Pregnant women lost their babies. The LA jails are not as bad but still not a place I would want to spend a day -- and I'm not even an arrogant debutante!

The hotel heiress was put under house arrest wearing an electronic tag after serving just THREE days.

Officials confirmed Paris, 26, was let out “for medical reasons”.

It emerged that the depressed socialite had refused to eat inside the Century Regional Detention Facility in Los Angeles, and had cried herself to sleep every night.

Medics and guards feared she would have a total nervous breakdown. There were even concerns she might try to kill herself.

But last night US legal analyst Susan Filan said: “It makes a mockery out of the legal system. It’s nothing other than special treatment.”

The Sun Online broke the news that Paris was out yesterday. The star of TV’s Simple Life was supposed to serve 45 days for violating her probation for a drink-drive conviction and driving on a suspended licence.

This was reduced to 23 days. But she went inside late on Sunday and came out at 2.09am yesterday, having completed just three full days.

She is now confined to her LA mansion for 40 days and must wear an ankle tag.

Paris was housed in the jail’s “special needs” unit, apart from most of its 2,200 inmates, and spent 23 hours a day in solitary confinement. A psychiatrist had apparently warned staff that the Simple Life star was cracking up.

Inmates on the jail’s K Wing said picky Paris refused to eat prison food — even though her cell was more luxurious than those of other cons.





A jail insider told The Sun: “Paris told prison authorities she couldn’t eat because she was so petrified. She told them she was terrified of being attacked by other inmates and felt seriously depressed. She was crying so much that authorities made sure doctors checked regularly upon her.

“It was after these checks that it was decided to release Paris and put her under house arrest.” But ex-inmate Antoinette Wilkerson, 32, who recently did 33 days for assault, said: “This is an outrage. Paris has only been let out because she’s a little rich white girl. When the rest of us cry or say we’re depressed we’re ignored.”

Another former lag Cynthia Chavez, 53, said: “You have to be dying to get transferred out of here. It’s wrong.”

Last night Paris said: “I want to thank the Los Angeles County Sheriff’s Department and staff of the Century Regional Detention Center for treating me fairly and professionally. I hope that others learn from my mistakes.”

A spokesman for the LA County Sheriff said: “Once she has done her 40 days, she has paid her debt to society.”

...it's crap that everyone is making so much out of this. Prisons are over-crowded and nobody serves their time - not even killers. Everybody gets out early. When the press falls for it - their indignation only feeds the Paris Hilton Publicity Machine.

Sure - she's another rich person getting a break. The only difference this time is that she's hot. If it was Shirley Maclean or Meryl Streep, nobody would care - except me, for fear of having either of those two availible to make another movie I might have to watch.

it is actually illegal to take photos ofpeople without their permission! there was a big fight here on flickr about this guy who was taking photos of girls on the street without them knowing. they were of age, but they had mimi skirts on, they were very pretty-

He obviuosly could only shoot them at a distance. Many claimed tha this was illegal and a violation.

Anyone know that law-

I know of course for underage it would be illegal but what about for adulta who don't know if you are taking their picture?

In Australia any person in a public space can be photographed.

If they choose to expose themselves then you can legally photograph them, The only exceptions are voyeuristic "Upskirt" photos or similar.

There is nothing hidden or private about these bodies!!!

In a recent case a photographer was expelled from a beach in Australia for photographing topless bathers. It turned out that topless bathing at that beach was illegal and photography was legal.

Such is the power of the press and opinion to try and stop public photography. I just had the Australian Government take down a web page advising sporting clubs to prevent photography of children's sport as the advice they were giving was totally incorrect and in some cases against the law.

As photographers we need to be vigilant and protest loudly against people and laws restricting our freedoms.

Upskirt is an invasion of privacy in that a woman's panties or lack of them is usually not on open display.

IE if a woman openly lifts her skirt to display what is underneath then no law is broken.

If the photographer photographs up under her skirt without her consent or knowledge then the law is broken.

The area under a woman's skirt is what a normal person would consider a private area, even if it is in a public space. The same with public toilets, showers and changing areas public access but areas normal people would expect privacy.

A woman in a longer skirt accidentally exposes her knickers it becomes different story. The thing is the expectation of privacy Does the woman expect such things to be private? In your photo obviously the young lady has no problem exposing her breasts to the public so she must also expect to be photographed.

If a 13 year old girl is in a bikini on a beach then taking her photo is also acceptable.

If say a young girl in a skirt is doing handstands or playing on playground gym equipment and her dress rides up exposing her panties then I would expect that she has a legal right to privacy.

The law must take intent into this as well a parent taking photos of a daughter doing handstands OK. Some old guy with a "Young girls panty" website then he would have a hard time explaining why he was taking the photos.

We look at the photos of Sally Mann and Jock Sturgess of naked young children, it is the same questions being asked.

if you choose to sunbake nude in a private garden surrounded by a high wall and I climb that wall and photograph you where you could expect privacy then I have breached the law.

Does the woman on the beach have a choice if her breasts are exposed or not?
Does the woman on the beach expect people to look at her breasts?
Does she seem concerned if people view her breasts?
Do I have a right to take photos of beach scenes on that beach?

If it a public thing being done in the open in a public space then I have no problem with recording it as a normal everyday part of life.

I do have a problem with a government preventing me from taking photographs in a public area. Once a precedent is set then the flood gates open for the banning photography in public areas and this is something I strongly object to.

I agree with you, dug, as a main principle. But at the same time I think about myself. Suppose I go to a nude beach. I go there as a place where people think of nudity as a natural thing. But I'm not expecting that a pic of me will be taken and shown out of that place to people that don't practice nudism and that don't know that I practice it: friends, family, pupils... I wouldn't be nude in the middle of the street, only on that beach, so maybe, if I found my nude pic in a public website I'd feel as if I was suddenly nude in a place different form that beach. Imagine that that girl went to a beach very far away from where she lives, very different country... and that she'd never go topless on a beach near her home. She's feeling save from being seen by her friends, family, work mates... Maybe she won't like very much to find that pic in a public place. For me it's different that you take a pic on the beach and keep it for yourself (you was able to see her, so it doesn't seem to be a big deal that you have her pic) and that you make that pic public. If the world was perfect, just different, we shouldn't care about it, but reality tells us that a lot of people around us won't see it in such a natural way, so we should have the right to keep our nudist practice as a private activity and keep the right to let know about it only if we want. I'm not sure if I explained it right...

Certainly in the UK there is no presumption in law that we are protected from photography in public places. You are quite at liberty to photograph people in public places without their consent and without conferring any rights over your photos to them. You can be prosecuted (in the UK at least) if your actions violate other laws. (Chasing a person down the street or jumping out of the bushes at someone might get you charged with harassment whilst upskirt shots may well be viewed as indecency or even sexual assault.

Regarding aselluza's comment about going a long way from home, in the hope of your actions not getting back to your friends etc etc, again, if you're in a public place you have no expectation of privacy and should behave accordingly (or don't complain about the outcome). I suppose if it's a private nudist beach it's a different story.

Having said the above, I'd be very careful about photographing 13 year olds doing anything given society's current views / hysteria about this sort of behaviour.

Alycidon has it right. With regards to popel under the age of 18 then you would normally have to gain parental permission. So when I go to hockey games I try to avoid taking shots of kids as it is so much hassle getting permissions. You'd also need CRB clearance for shooting junior sports. Taking any form of phtogrpah in a swimmming pool is a big no- no. If I'd taken the shot on the beach as you had done I would be wary of posting it on the net as the woman on her back is recognisable. Were it less of a close up I wouldn't post it.

the problem with this statement is, in the united states at least, is this "right" is imagined. there is no right protecting you from being photographed, even if you are a minor - as long as you are in a public space and the photographer isn't doing things like attaching a camera to his shoe to try and take upskirts.

the only real right you have in terms of being photographed is your likeness being used in advertisements... for example if i saw you drinking a coca-cola and took your picture, i could not then use that picture in a coca-cola advertisment without getting your release. but that has more to do with civil law than criminal, and with the rules that govern royalties for being in an ad and so forth...

as far as what johncoxon says above, if you are shooting at a NHL hockey game, you are in a stadium that is owned by the NHL most likely, and they probably have posted rules, and they can tell you what you can or cannot take pictures of on their property... the same for a beach, if it's a privately owned beach, the owner can post signs saying no photos and you are legally obligated to not take pictures.

of course, since that picture was taken in tunisia, who knows what the laws there say.

I think most countries have similar laws - it is not illegal to take photographs in a public space (as long as there is not a government building, or of a member of the police, military etc), as long as you do not evade their rights - i.e. up skirt shots. However if wish to reproduce that image or post it on any website etc it is appropriate to get a model release signed by that person - if not they can sue you or take you to court to get the image removed or fee for the image.

ian rendle, i have had plenty of photos published in newspapers and magazines and i never got photo releases, nor did my photo editors ever request one. when you start to use someone's likeness to market a product, however, you do need a release- it's a whole different legal world at that point. news photos (or "news" photos in the case of paparazzi) do not need model releases. any form of advertising, even self advertising, does.

think back to a few years ago, during the world series (i believe, it might have been another big sports event), there was a couple who ended up in the background of some photos and video because they were frolicing around naked and having sex in their hotel room, which overlooked the sports arena, with their window open. those people ended up in pictures because they had the lack of foresight to realize they would end up in pictures, and there wasn't anything they could do about it.

I mean that I wouldn't make public a pic of anyone I don't know if I think that that person might object something to it. I wouldn't do to another something I wouldn't want any other did to me. I suppose that if we acted that way laws wouldn't be needed. I myself think that laws are made to be broken. I'm sure you understand what I mean ;-)

About the US law: I was in a mall near Boston a couple of years back and I took a shot of a coffee shop within that mall. The woman behind the counter came out and challenged me for taking that pic. She claimed it was illegal to take pictures, as people in the frame may not have wanted to be in it (including the staff).

What's your view? Was she right? Is a mall considered a public place, or a private place (as it must belong to someone)?

a mall is privately owned property, virtually all malls have posted rules that say no photography. (though the rules are usually not posted very large, they are there). it its completely within the rights of the mall to forbid photography on their premises, and as a law abiding photographer you are obligated to follow their wishes on their property.

however, the worst they could do to you if you DID take pictures was kick you out... that is, unless you were being harassing about it. the best thing to do if told to stop taking pictures on private property is to say "i'm sorry i did not realize that i wasn't supossed to take them here, i will stop."

the same concept is why you can be kicked out of a concert venue for taking pictures of a performer without a photo pass - the venue is free to ban photography on their property.

hey gail, keep on your work! i get also such kind of messages, when i report about things very critical! and after all the blames, aggressive letters etc. i still say, journalists have to confront the public with the facts, because that is the way everyone of us starts to think. the media landscape should be more diverse and interested to report more about the background of a topic. a lot of journalists don't do their work thoroughly, which has consequences for the possibility for media consumers to reflect topics variously. such e-mails have to be seen as a signal that your work induces something! keep on your confrontiv work!
